Terms of Service

1. Who you are contracting with

EchoMind (the "Service") is operated by HorizontAce ("HorizontAce", "we", "us"). By creating an account or using the Service you enter into a binding agreement with HorizontAce on these Terms. If you do not agree, do not use the Service.

2. Your account

You must be at least 13 years old to use EchoMind. You are responsible for your login credentials and for activity under your account. Keep your password confidential and provide accurate information.

3. Your content

You own the voice recordings, habits, journal entries, and community posts you create ("Your Content"). By posting to the Circle feed you grant HorizontAce a limited, non-exclusive license to store and display that content to other signed-in users of the Service. You can delete Your Content at any time.

4. Acceptable use

• Do not post content that is illegal, abusive, harassing, or hateful.
• Do not impersonate others or misrepresent your identity.
• Do not attempt to reverse engineer, scrape, or clone the Service.
• Do not use automated systems to submit content, harvest data, or overwhelm the Service.
• Do not use the Service to distribute malware or probe security.

5. Subscriptions, billing, and Merchant of Record

EchoMind offers paid subscription plans (currently EchoMind Plus and EchoMind Pro, billed monthly or yearly). Current pricing is shown on our Pricing page. Paid plans renew automatically at the end of each billing period until cancelled. You can cancel at any time from the billing portal linked in your Profile; cancellation takes effect at the end of the current period and you keep access until then.

Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics for your subscription are governed by Paddle's Buyer Terms in addition to these Terms. For refund requests see our Refund Policy.

6. Intellectual property

EchoMind — including the name, logo, app design, source code, and written copy — is the proprietary property of HorizontAce and is protected by copyright, trademark, and other laws. Except for Your Content, you may not copy, modify, distribute, sell, or create derivative works from any part of the Service without prior written permission. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.

7. Not medical advice

EchoMind is a wellbeing tool, not a medical device. It does not provide diagnosis, treatment, or professional mental-health care. If you are in crisis, contact local emergency services or a qualified professional.

8. Suspension and termination

We may suspend or terminate accounts for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may delete your account at any time by contacting privacy@echo-mind.world.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation. Keep your own backups of anything important.

10. Limitation of liability

To the maximum extent permitted by law, HorizontAce is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our aggregate liability is limited to the fees you paid in the twelve months preceding the claim.

11. Changes

We may update these Terms from time to time. Material changes will be announced in the app, and the date above will be updated.
